GENERAL RESERVATION TERMS INTRODUCTION

1.- IDENTIFICATION OF THE PARTIES.

On one hand, Lutx Corporació S.L. (hereinafter referred to as the Hotel) with address at Calle Consell de Cent, 357 2nd Floor - 08007 Barcelona.

On the other hand, the client whose details are provided in the reservation form.

The Client declares to be of legal age and have sufficient legal capacity to enter into contracts acting on their own behalf and right.

2.- OBJECT

This document aims to inform you about the general conditions applicable to the processing of reservations through the website https://www.hcchotels.com/

On the website you will find information about the services provided by the hotel, the availability of rooms, and the rates applicable at any given time.

Processing the reservation implies the full acceptance without conditions of the legal notice, the privacy policy, and these general conditions in their latest version. Therefore, we recommend that you read these conditions before formalizing your reservation.

These General Conditions may only be modified by the legal representation of the Company. The modification will always be in writing, and cannot be altered by any other person who does not hold the legal representative status of the Company.

These General Conditions may be supplemented with Specific Conditions that are generated. In case of a discrepancy between the particular and the general conditions, the general conditions will prevail.

3.- CLIENT'S STATEMENTS

The Client states that the data provided when formalizing the reservation are true, complete, and concise.

That they confirm the requested reservation and especially the indicated dates, the number of rooms, people, accommodation, and the chosen regime.

4. WEB ACCESS

Access to this website is the responsibility of the user and is subject to the portal's rules of use described in the legal notice.

5. CONTRACTING OF PRODUCTS AND SERVICES THROUGH THE WEB:

• 5.1. Before making a reservation on our website, you will be informed of the services and the specific conditions of the current offer at that time.
• 5.2. The present general and specific conditions must be accepted by you before formalizing the reservation. The contract can be formalized in any of the languages available on the website.

6. THE RESERVATION FORMALIZATION PROCESS ON THE WEB DEVELOPS IN THESE STEPS:

• Choice of the hotel.
• Availability: search for dates, number of people and rooms, introduction of promotional code if available.
• Choice of room type, regime, rate, and activation of discounts for joining the HCC Club if desired.
• Selection of extra services.
• Summary of the reservation, collection of client data and, where applicable, payment via virtual POS.
• Confirmation of the reservation.
• Once the reservation is made, the emails and logs generated by the operation will be archived. The client will receive the details of their reservation by email, along with a number that will identify it (locator).

7. PRICE AND PAYMENT:

• 7.1. The conditions, price, and payment for the projected stay are as determined expressly in the rate conditions included on the page where you make the reservation.
• 7.2. Promotions and offers are only valid for as long as they remain accessible to the service's recipients.
• 7.3. The prices indicated on the hotel's website are Public Sale Prices, and include VAT. The transaction will be in EUROS, regardless of the client's origin.
• 7.4. Along with the prices, information is also provided about the tourist tax of the city of Barcelona that must be paid at the hotel itself once accommodated.
• The price and conditions offered on our website may vary at any time, even if you request the same dates.

8. CANCELLATIONS/MODIFICATIONS OF RESERVATIONS AND NO-SHOWS:

• 8.1. They will be as stated in the selected offer.
• 8.2. All charges applied will be made on the credit card provided in your reservation. You expressly consent to these charges to cover any applicable penalties for cancellations or no-shows.

9.- PLACE OF CELEBRATION OF THE CONTRACT AND DURATION.

The contract is deemed to be executed at the company's registered office and will have the duration specified in the reservation.

10.- RIGHT OF WITHDRAWAL:

In any case, it must be remembered that, for the hiring of accommodation services, the exercise of the withdrawal right provided for in Law 3/2014, General Law for Consumers and Users, does not apply.

11.- RIGHT OF ADMISSION

12.- DATA PROTECTION.

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, and Organic Law 3/2018, of December 5, on Data Protection and Guarantee of Digital Rights, we inform you that:

13.- NOTIFICATIONS

All notifications, requirements, requests, and other communications to be made by the parties in relation to these general conditions must be made via email or through the contact form available on the website.

14.- ACCEPTANCE

The request and formalization of the reservation necessarily imply that each and every one of these general conditions, considered as an integral part of the reservation and supplemented by the rate conditions and the specific applicable legislation, are expressly accepted by you.

15. APPLICABLE LAW AND JURISDICTION

This contract will be governed by Spanish law, with an illustrative non-limiting character, these general conditions being subject to the provisions of Law 7/1998, of April 13, on General Contracting Conditions, Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and users and other complementary laws, Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, as well as all the applicable tourism regulations and, subsidiarily, the Civil Code and the Commercial Code.

For any dispute that may arise concerning its validity, execution, compliance, or resolution, in whole or in part, the parties, with express waiver of their own jurisdiction if they have it, expressly submit to the jurisdiction and competence of the Courts and Tribunals of BARCELONA.

16. OTHERS

Policy on admission of pets: Pets are not allowed in the hotel.
